Terms & conditions

By commissioning Tonina Ryan Photography, you agree to the following Terms and Conditions.

1. Acceptance

In commissioning our services, you accept these Terms and Conditions in full.

2. Copyright

Tonina Ryan Photography retains copyright and all moral rights in every image produced. We retain ownership of all original captures and processed files. We reserve the right to use images in promotional materials and social media. If you do not consent to this, please advise in writing at the time of booking.

3. Usage Licence

You may use images for the media, territory, and duration outlined in your Usage Licence. The licence is not transferable and images may not be passed to third parties without written permission. Additional usage attracts additional fees.

4. Cancellations & Postponements

A booking is confirmed on the date of acceptance. Cancellations or postponements for reasons other than weather attract a charge of 50% of photography and pre-production fees, plus all direct costs. Cancellations within 48 hours attract 100% of these fees.

5. Weather

Postponements due to adverse weather conditions attract a charge of 75% of photography, pre-production, and crew fees, plus 100% of direct costs (accommodation, travel, equipment hire, etc.).

6. Indemnity & Loss

Tonina Ryan Photography is not liable for any claims or damages arising from the use or distribution of images. In the unlikely event that files are lost or destroyed due to circumstances beyond our control, our liability is limited to a full refund of payments received.

7. Client Approval

You are responsible for having an authorised representative present during the shoot to approve photography. If no representative is present, the photographer's interpretation of the brief is accepted as final.

8. Reshoots

If a reshoot is requested by the client, 100% of all original costs and fees will be charged.

9. Payments & Deposits

Full payment is required by the due date on the invoice. A deposit must be paid before the shoot commences where indicated. Images are not released and usage rights are not granted until payment is received in full.

10. Overtime

If a shoot extends beyond eight consecutive hours, overtime may be charged at 1.5× the hourly rate.

11. Late Payments

Unpaid invoices attract a $100 late payment fee and interest at 1.4% per month, compounding from the due date. All collection costs are recoverable as a debt. Legal proceedings will be issued in Victoria, Australia.

12. Deliverables

Retouched images are delivered via a download link in high-resolution and web-resolution formats. The link remains active for two months. Clients must download and archive all files promptly.

13. Retouching

Standard editing is included in your quote. Additional retouching is charged per image at the photographer's discretion.

14. Archiving

Tonina Ryan Photography archives images for six months from the date of the session or event.

15. Website Use

All content on this website — including images, text, and design — is the property of Tonina Ryan Photography and is protected by copyright. Unauthorised use is prohibited. For enquiries, contact tonina@toninaryan.com.au.
